A federal judge in Montana on Friday ruled that the U.S. Forest Service is violating the federal Clean Water Act when it discharges fire retardant into creeks, rivers and lakes while battling wildfires in 10 Western states, including California. The ruling comes more than seven months after an Oregon-based environmental group filed a lawsuit against the Forest Service to prevent the federal agency from releasing fire retardant into federal waterways without a permit from the U.S. Environmental Protection Agency.
